Regional Sponsored Migration Scheme (RSMS) Subclass 187 Visas

The Regional Sponsored Migration Scheme or RSMS visa is a permanent employer sponsored visa which requires a job offer in a Regional Area of Australia.

RSMS Application Stages

There are in general three stages to an RSMS application:

  1. RCB Certification: the Regional Certifying Body will ensure that the position is genuine and in many cases require that the position has been advertised
  2. Nomination: review of the business and position by the Department of Immigration
  3. Visa application: there are three pathways, and generally the skill level is lower than for the ENS program. Applicants must be aged under 50, unless exceptional circumstances apply.

What this visa lets you do

The Employer Nomination Scheme (Subclass 186) is a Permanent Residency visa. Once granted, it allows the holder (and any family members included in the application) to:

  • stay in Australia indefinitely
  • work and study in Australia (without restriction)
  • travel to and from Australia for five years from the date the visa is granted
  • enrol in Medicare (Australia’s universal health care scheme)
  • apply for Australian citizenship (subject to eligibility)
  • sponsor eligible relatives for a variety of temporary and permanent Australian visas

Note: These is an obligation to remain in the nominate position, with the nominating employer for at least the first two (2) years of the visa.

The five year travel restriction only prevents re-entry into Australia after the expiry of the five year period, after which time (in order to re-enter Australia), a Resident Return visa or other suitable visa will need to be obtained. The Temporary Residence Transition Stream

If you are on a 457 visa, worked in Australia for at least 2 years (excluding period of unpaid leave) in the same occupation with the nominating employer and if that employer is looking to offer you a permanent position, you can apply for 186 visa under the temporary residence transition stream.

No Skill Assessment is required under this stream. However, English level equivalent to IELTS 5 (each module) is required unless exempted. Additionally, any secondary applicant who are over 18 need to meet the Functional English ability (Overall score of IELTS 4.5 or equivalent) in last 12 months unless exempted

The Direct Entry Stream

If you are eligible to be sponsored under the temporary residence transition stream but have a nomination from the regional employer for a permanent position, you can be eligible to apply under the direct entry stream.

Skill Assessment is mandatory under this stream. However, English level equivalent to IELTS 6 (each module) is required. Additionally, any secondary applicant who are over 18 need to meet the Functional English ability (Overall IELTS 4.5 or equivalent) in last 12 months.

The Temporary Residence Transition stream is designed fLINKor holders of a 457 visa who wish to transition into permanent residency, provided their nominating employer wants to offer them a permanent position.

Direct Entry Stream

The second stream, the Direct Entry stream, is ideal for applicants who have been nominated by their employer under this stream, have never (or briefly) worked in Australia, or are temporary residents who are not eligible for the Temporary Residence Transition stream.

Agreement Stream

If applicants are sponsored by an employer through a negotiated formal labour agreement, the Agreement stream is a direct pathway to permanent residency.
